Legislative Changes in the Civil Service
In 2012 June 29, the Parliament of Georgia made a series of amendments to the laws of Georgia – on Civil Service and on the Conflict of interest. The Civil Service Bureau is an author of the project of legislative changes, which serves the need of improving and simplifying a wide range of issues within the civil service.
Recent legislative changes:
Due to the current legislative changes, Legal entities of Public Law (with the exception of LEPLs established for a religious, educational and cultural purpose) are obliged to announce vacancies in accordance with the Law of Georgia on Civil Service - via www.hr.gov.ge;
The amendments introduced a limitation on the appointment of acting officials, by restricting acting appointments to one cycle; Nowadays individuals (high ranking officials) may be appointed as acting officials for no longer than 1 year, while other positions (public servants) may be subject to acting appointments for no longer than 3 months. Furthermore, individuals (both senior officials and public servants) cannot be re-appointed on the same acting position for more than one term;
The civil servants are no longer obliged to submit asset and income declarations. Due to those declarations did not even promote transparency and nor had any tax purposes. Instead, positions that have higher corruption risk were determined as Senior Public Officials and now are required to submit Asset Declaration;
Pursuant to the Law of Georgia on Civil Service a civil servant may be promoted to a higher position, if he/she has served at least 6 months on a previous position. Amendment to the law abolished this limitation and now provides opportunity for the civil servants to be promoted in less than 6 month of service, in case their professional qualification corresponds to the requirements of the higher position;
The law of Georgia on Civil Service didn’t foresee the probation period for the persons appointed on the basis of competition or for promoted civil servants. Under the current legislative changes those gaps were eliminated.
